Humanitarian & Compassionate (H&C) Applications
A Humanitarian and Compassionate (H&C) application is a request to become a permanent resident of Canada based on exceptional circumstances that justify an exemption from normal immigration requirements. H&C is a discretionary pathway — there is no right to H&C consideration.
When to Use H&C
H&C is for people who:

H&C Factors Considered
IRCC considers the following factors when making an H&C decision:

Application Process
- Prepare comprehensive application — detailed submissions with supporting evidence
- Submit to IRCC — with processing fee
- Pre-removal risk assessment — may be done simultaneously
- IRCC review — officer assesses all factors
- Decision — approved (stage 1) → additional processing for PR
- If approved — medical, security, then PR status

Tips
- H&C is very difficult to win — approval rates are lower than refugee claims
- Legal representation is essential — H&C submissions require strong legal arguments
- Best interests of children is the strongest factor — if applicable, emphasize this
- Document everything — the more evidence of establishment, the better
- H&C takes years — but it may be your only option
- Simultaneous with PRRA — you can have both pending
